Rules for buying and selling fishing tackle

1.General provisions
1.1.These E-shop Rules (hereinafter referred to as the "Rules") are a binding legal document for the Buyer and the Seller (hereinafter referred to as the "Seller"), which defines the rights and obligations of the Parties, the terms and conditions and procedures for the purchase, payment, delivery and return of the goods, as well as other conditions relating to the purchase and sale of goods on the online shop.
These rules are drawn up in accordance with the Civil Code of the Republic of Lithuania, the Law on the Protection of Consumer Rights of the Republic of Lithuania, the Directive on Electronic Commerce and sub-legislative acts.
1.2.For the purposes of these Terms and Conditions, a Customer is a person who has registered and purchases or only purchases (places an order) in the Online Shop.
The Buyer agrees to these Terms and Conditions by registering/purchasing (placing an order) on the website of the online shop Zvejybosreikmenys.lt.
You can buy online:
1.2.1.a natural person with legal capacity, i.e. a person who has reached the age of majority and whose legal capacity has not been limited by a court order;
1.2.2. a minor between the ages of 14 (fourteen) and 18 (eighteen) with the consent of his/her parents or guardians, unless he/she is emancipated or has independent disposal of income;
1.2.3.legal person;
1.2.4. duly authorised representatives of all the above persons.
1.3.By registering or placing an order, the Customer unconditionally confirms that he/she has the right to make purchases in the Online Shop.
1.4.The Seller reserves the right to change, amend or supplement these Terms and Conditions at any time. The Buyer shall be informed of any changes to the Terms and Conditions on the website of the electronic shop Zvejybosreikmenys.lt. Changes shall become effective from the moment of publication for all transactions after the publication, therefore the Buyer is recommended to familiarize himself with the Terms and Conditions during each shopping trip.
1.5.The Buyer confirms the Terms and Conditions by reading them and ticking the box next to the statement "I have read and agree with the rules of buying and selling goods in the electronic shop Zvejybosreikmenys.lt". The Rules thus approved shall be a binding legal document for the Parties, which sets out the rights and obligations of the Buyer and the Seller, the conditions for the purchase of goods and payment for them, the procedure for the delivery and return of goods, the liability of the Parties, and other conditions related to the purchase and sale of goods at Zvejybosreikmenys.lt.
1.6.By creating an account at Zvejybosreikmenys.lt, the Buyer confirms the Terms and Conditions during the first registration. If the Buyer accepts the Terms and Conditions at the time of the first registration (creation of the account), a long-term purchase and sale agreement shall be concluded between the Buyer and the Seller. The Terms and Conditions approved at the time of the first registration shall apply to all purchases made by the Buyer until the updated Terms and Conditions are published. Information about updates to the Rules is available on the website Zvejybosreikmenys.lt.
1.7.The Seller shall be exempt from any liability if the Buyer has not read the Terms and Conditions in whole or in part, although he has been given the opportunity to do so.
1.8.The Buyer is obliged to familiarize himself with the Seller's approved and publicly announced Privacy Policy. The Buyer shall express his/her consent or disagreement with specific uses of the Buyer's Personal Data in accordance with the procedures set out in the Privacy Policy itself.
2. Protection of personal data
2.1.Before making a purchase (placing an order) and before registering on the website of the online shop at Zvejybosreikmenys.lt, the Buyer must provide the data required for registration or ordering.
2.2.By agreeing to these Terms and Conditions, the Buyer agrees to the sending of notifications to the email address provided by the Buyer which are necessary for ordering, payment and delivery of the goods.
2.3.The Buyer is also obliged to provide his/her personal data (name, surname, delivery address, telephone number), which is necessary for the purchase, delivery and payment of the goods.
2.4.By registering, the Buyer grants the Seller the right to collect, store, systematize, use and process, for the purposes set out in these Terms and Conditions, all and any personal data that the Buyer provides directly or indirectly by registering and visiting the e-shop.
2.5.The personal data provided by the Buyer will be processed in accordance with the requirements of the Law on Legal Protection of Personal Data of the Republic of Lithuania, as well as other legal acts of the Republic of Lithuania regulating the processing and protection of such data. When processing and storing the Buyer's personal data, the Seller shall implement organisational and technical measures to ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure, as well as against any other unlawful processing.
2.6.The personal data provided by the Buyer will be used exclusively by the Seller and its partners with whom the Seller cooperates in the administration of the e-shop, delivery of goods and/or other services related to the placement or execution of the Buyer's order. The Seller will not disclose the Buyer's personal data to third parties, except for the partners mentioned above in this clause, or in the cases provided for by the legislation of the Republic of Lithuania, after having been ordered to do so.
3. Concluding a sale and purchase agreement
3.1.The contract of sale between the Buyer and the Seller shall be deemed to have been concluded when the Buyer forms and submits an order for goods in the online store by clicking on the "ORDER" link.
3.2.Upon conclusion of the Sale and Purchase Agreement, the range of goods, quantity, price, delivery time and other terms and conditions specified by the Buyer at the time of placing the order shall be binding on the Buyer and the Seller and may be changed only in accordance with the procedure set out in these Terms and Conditions.
3.3.Purchase and sale contracts are registered and stored in the Zvejybosreikmenys.lt database.
4. Buyer's rights
4.1.The Buyer has the right to purchase goods in the online store Zvejybosreikmenys.lt in accordance with these Rules.
4.2.The Buyer shall have the right to withdraw from the contract of sale of goods concluded in the e-shop by notifying the Seller in writing no later than within 14 (fourteen) calendar days from the date of delivery of the goods.
4.3. the Buyer's right under point 4.2 shall be exercised in accordance with Article 6.22810(1) of the Civil Code.
4.4. the Buyer may exercise the Buyer's right referred to in clause 4.2 only if the goods have not been damaged or substantially altered in appearance and have not been used.
4.5.Cancellation or adjustment of the ordered and created Shopping Cart is not possible.
5. Seller's rights
5.1.If the Buyer attempts in any way to undermine the operation of the online store, data security or violates other obligations of the Buyer mentioned in Clause 6, then the Seller shall have the right to restrict access to the online store Zvejybosreikmenys.lt
5.2.When the Buyer cannot be contacted within the specified time limit for the chosen delivery method, even though the Buyer has prepaid for the goods, the order is cancelled and returned to Zvejybosreikmenys.lt
6. Obligations of the buyer
6.1.The Buyer shall pay for and accept the goods purchased in accordance with these Conditions.
6.2.If the Buyer refuses to accept the goods at the time of delivery without good reason, the Buyer shall be liable for the cost of returning the goods upon the Seller's request.
6.3.The Buyer undertakes to protect and not to pass on to third parties his/her login data to the Zvejybosreikmenys online shop. If the Buyer loses the login data, he/she is obliged to inform Zvejybosreikmenys.lt immediately
The Seller shall not be liable for the actions of third parties after the use of the Buyer's login data until the moment of informing and allowing the web shop administrator to change the Buyer's login data. In this case, Zvejybosreikmenys.lt has the right to assume that the Buyer has performed the actions in the online shop.
6.4.The Buyers of the online store Zvejybosreikmenys.lt are obliged to abide by these Terms and Conditions, which are explicitly stated in the information sections of the online store, and not to violate the legislation of the Republic of Lithuania.
7. Obligations of the Seller
7.1.The Seller undertakes to make available the services of the online shop, the conditions of operation of which are set out in these Terms and Conditions and other terms and conditions published in the online shop Zvejybosreikmenys.lt.
7.2.The Seller undertakes to deliver the goods purchased by the Buyer by the method of delivery chosen by the Buyer in accordance with the terms and conditions set out in these Conditions.
7.3.The Seller undertakes to respect the Buyer's right to privacy with regard to personal information belonging to him.
7.4.When, due to unforeseen circumstances, the Seller is unable to deliver the goods purchased in the online store Zvejybosreikmenys.lt, the Seller shall have the right to terminate the Purchase and Sale Contract by informing the Buyer beforehand. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the money paid within 5 working days.
7.5.If the Buyer exercises the right provided for in Clause 4.2 of the Terms and Conditions and under the condition provided for in Clause 4.4 of the Terms and Conditions, the Seller undertakes to refund the Buyer the money paid within 7 (seven) days from the date of delivery of the returned goods to the Seller.
7.6.The Seller may not refund the amount paid by the Buyer until the Goods have been returned to the Seller or until the Buyer has provided proof that the Goods have been dispatched to the Seller, whichever is the earlier.
7.7.The Seller undertakes to provide the Buyer with clear and comprehensible information as set out in Article 6.2287 of the Civil Code of the Republic of Lithuania.
7.8.The Seller will not refund the Gift Certificate.
8. Commodity prices
8.1.The prices of goods in the online shop and in the order placed with Zvejybosreikmenys.lt are quoted in the currency of the country. The Seller is a VAT payer. VAT is included in the price and delivery charges are added to the total amount of the goods upon confirmation of the order.
8.2.The retail (discounted) prices displayed in the online shop are provided by the suppliers or official distributors of the goods sold. The reduced prices are the manufacturer's recommended retail prices for goods sold at the sellers' direct outlets, showrooms and shops.
9. Ordering and paying for goods
9.1.When visiting the online shop, the customer chooses the items he likes, on the basis of which a shopping cart is formed. After the shopping cart has been formed, the Customer shall enter the data necessary for the delivery and purchase of the selected goods: his/her name, surname, the address to which the goods will be delivered, telephone number and any additional information that may be relevant for the delivery of the ordered goods.
9.2.The order shall be forwarded for further execution only from the moment of payment by Paysera or Paypal transfer, the contract shall be deemed to be executed when the payment of the Buyer is received;
9.3.The Customer may pay for the Goods by one of the methods and conditions provided by the e-shop:
9.3.1.Paysera or Paypal transfers;
9.4.The prices of the goods in the online shop and in the final order window are quoted in euros including VAT.

10. Delivery of goods
10.1.When ordering goods, the Buyer must choose a delivery service and specify the exact delivery address.
10.2.The buyer must accept the goods himself. If the Buyer is unable to take delivery of the goods himself, but the goods are delivered to the address specified by the Buyer, the Buyer shall not be entitled to make any claim in respect of the delivery of the goods to the wrong person.
10.3.The Seller shall deliver the Goods to the Buyer in accordance with the terms specified in the descriptions of the Goods. These time limits are provisional and do not apply in cases where the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered. By reading these Terms and Conditions, the Buyer agrees that in exceptional cases the delivery of the Goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such event, the Seller undertakes to contact the Buyer immediately to agree the terms and conditions of delivery.
10.4.Goods are delivered to the customer:
- Via DPD courier service*
*Delivery prices are subject to change depending on the partner's offers at the time. The cheapest delivery method in other areas (except Vilnius city) of the Republic of Lithuania.
In the event of withdrawal from the contract of sale of the goods (i.e. returning the goods to us), we will decide on the reimbursement of the delivery costs in accordance with the legal requirements. As provided for in Article 6.22811(3) of the Civil Code of the Republic of Lithuania, the Seller is not obliged to reimburse to the consumer the additional costs incurred as a result of the consumer's express choice of a method of delivery other than the cheapest usual method of delivery offered by the trader.

The delivery charge is per order.
The buyer will see the exact amount of the delivery charge before confirming the order. The amount of the delivery charge will not be changed after the order has been confirmed.
10.5.The Seller shall not be liable for any breach of the time limits for delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties not related to the Seller or due to circumstances beyond the control of the Buyer.
Delivery times are given in the product descriptions. They are provisional and subject to change.
10.6.Upon receipt of the Goods, the Buyer must, together with his authorised representative, inspect the condition of the consignment (whether the outer packaging is intact) and sign the invoice, bill of lading or other document of transfer and acceptance of consignment. Once the Buyer has signed the invoice, bill of lading or other document of transfer and acceptance of the consignment, the consignment shall be deemed to have been handed over in good condition.

If the Buyer notices that the packaging of the delivered consignment is damaged (crumpled, wet or otherwise externally damaged), the Buyer must note this on the invoice, bill of lading or other document of transmission and acceptance of the consignment and, in the presence of the Seller's representative, draw up a free-form consignment damage report. If the Buyer fails to do so, the Seller shall be exempt from liability in respect of damage to the Goods, provided that such damage is not due to manufacturing defects, and in respect of inconsistencies in the assembly of the Goods, provided that such inconsistencies can be determined from an external inspection of the Goods.
If the Buyer, upon receipt of the consignment, notices any discrepancy, manufacturing defect or other defects in the goods, the Buyer shall inform the Seller immediately (within 24 hours of receipt of the consignment at the latest). If the complaint is confirmed and the Buyer returns the goods of unsatisfactory quality, the Seller undertakes to refund the money for the goods within 14 (fourteen) days, together with the costs of return.
10.6.1.The characteristics of all goods sold shall be set out in the description accompanying each item. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer;
10.7.In the event of the Buyer's withdrawal from the contract of sale of the goods, the Buyer shall be refunded all sums paid by the Buyer, including the costs of delivery of the goods paid by the Buyer. However, as provided for in Article 6.22811(3) of the Civil Code of the Republic of Lithuania, the Seller shall not be obliged to reimburse to the consumer the additional costs incurred as a result of the consumer's express choice of a method of delivery other than the cheapest usual method of delivery offered by the trader.

11. Returning goods
11.1.Goods of good quality can be returned within 14 days of receipt. The defects of the goods sold in poor quality shall be eliminated, the poor quality goods shall be replaced and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania and the "Rules of Retail Trade" approved by the Government of the Republic of Lithuania.
11.2.In order to return the item(s) in accordance with clause 11.1, the Buyer must complete a return document.
11.3.The following conditions must be observed when returning goods:
11.3.1.The returned goods must be in their original packaging in good working order (this does not apply in the case of low-quality goods);
11.3.2.The Goods must be in good condition and not damaged by the Buyer;
11.3.3.The goods must be unused and in good condition: labels must be intact, protective films must be intact, etc. (this does not apply in the case of returns of low-quality goods);
11.3.4.The returned goods must be in the same condition as when received by the Buyer (this clause does not apply in the case of returns of low quality goods);
11.3.5.When returning an item, you must present the document of purchase, the warranty card (if issued) and the completed return form;
11.3.6.The Seller shall have the right to refuse to accept the Buyer's return of the Goods if the conditions for the return of the Goods have not been observed;
11.3.7 The Customer shall return defective, faulty, damaged or otherwise unsatisfactory goods to the Seller at the Customer's expense;
If the Buyer has purchased goods of inadequate quality, the Buyer has the right to return such goods to Zvejybosreikmenys.lt. In this case, the defective goods shall be replaced with quality goods or the money paid by the Buyer shall be refunded.
Quality goods cannot be returned.
If the Buyer has been delivered the wrong goods, the Buyer must inform the Seller immediately, but not later than within 7 (seven) working days. The Seller undertakes to collect such goods and replace them with suitable goods at its expense. In the event that the Seller does not have the goods ordered, the Seller shall refund to the Buyer the money paid for the goods(s). The money shall be refunded to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's cancellation notice, and if the Goods have not been returned to the Seller by the Buyer, the time limit set out above shall be calculated as from the date of return of the Goods to the Seller.

11.3.7.The returns service is available:
- via DPD courier (service - arrival of the DPD courier, collection of the parcel at the address specified by the Customer and delivery to Dreamlook.lt).
11.3.8.The return of goods shall be made in the manner prescribed by the Seller within 14 (fourteen) days from the date of receipt of the goods (this clause does not apply in the case of low-quality goods, in which case the return of goods shall be made within the statutory warranty period);
11.4.Returns and exchanges of goods of satisfactory quality shall be carried out in accordance with Article 6.22810(1) of the Civil Code; if the Buyer returns a good quality product, the cost of returning it will be deducted from the amount of the refund. In the case of a return of a low-quality product, the costs of returning the product shall be borne by the Seller.
11.5.Money paid for goods accepted by the Buyer but subsequently rejected shall be refunded to the Buyer's account no later than 7 (seven) days from the date of return of the goods to the Seller, unless otherwise agreed between the Seller and the Buyer.
The Seller shall not be liable for a missed or delayed order for returned goods if the Buyer incorrectly provides the data required for the return.
12. Exchange of information
12.1.The Seller informs the Buyer using the e-mail address provided in the registration form, and the Buyer may use all the contact channels indicated in the "CONTACTS" section of the Zvejybosreikmenys.lt website.
13. Responsibility
13.1.The Buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer provides inaccurate data in the registration form, the Seller shall not be liable for the consequences arising therefrom and shall be entitled to claim direct damages from the Buyer.
13.2.The Buyer is fully responsible for his/her actions after signing up to the online shop Zvejybosreikmenys.lt.
13.3.The Buyer is responsible for the security of his/her registration data. If a third party uses the registration data, he/she shall be deemed to be the Buyer.

13.4.The Seller shall be exempt from all liability in all cases where the loss is caused by the Buyer's failure to read these Terms and Conditions (although given the opportunity to do so), despite the Seller's advice and obligations.
13.5.In the event of damage, the guilty party shall indemnify the other party for the losses incurred in accordance with the procedure and on the grounds laid down by the laws of the Republic of Lithuania.
14.Marketing measures taken by the trader
14.1.The Seller may conduct, modify or terminate promotions of various types.
14.2. The Buyer, agreeing to receive information notifications (newsletters) about Zvejybosreikmenys.lt promotions and offers to the e-mail address provided by him/her, ticks the checkbox during registration. If the Buyer does not wish, the Seller will not use the Buyer's personal data for marketing purposes and will not send the Buyer promotional or informative messages, except for those necessary for the execution of the order placed by the Buyer.
14.3.If the Customer does not wish to receive the offers addressed to him/her, or if he/she wishes to change his/her newsletter subscription settings, he/she may do so by logging into his/her account. If the Buyer does not wish, the Seller will not use the Buyer's personal data for marketing purposes and will not send the Buyer promotional or informative messages, except for those necessary for the fulfilment of an order placed by the Buyer.
15. Final provisions
15.1.These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.
15.2.These Terms and Conditions and the relationship between the Parties hereto shall be governed by and construed in accordance with the laws of the Republic of Lithuania.
15.3. Any disagreements arising out of the application of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
15.4.The Parties shall be excused from performance of their obligations under these Terms if performance is prevented by unforeseen circumstances beyond the control of the Parties, including:
- fire, explosion, storms and other natural disasters and acts of God which prevent or delay the fulfilment of the obligations assumed;
- an event or circumstance beyond the control of the contracting party (the Parties) which prevents or delays the performance of the obligations assumed;
- Actions by a government or authority that prevent or delay the fulfilment of commitments.
